Frequently asked questions

Answers To All The Oddly Specific Questions You May Be Too Polite To Ask

  • What makes a will really valid in England and Wales?

In England and Wales, you must be 18 or over, have the mental capacity to understand what you are doing, and make your will voluntarily, without pressure from anyone. The will must be in writing and signed by you in the presence of two witnesses who are both present at the same time, and they must then sign it in front of you. A witness, or their spouse or civil partner, should not be a beneficiary. Creating your will with us prepares the document; it only becomes valid once it is printed, signed and witnessed correctly. Different rules apply in Scotland and Northern Ireland.

  • How do I register a lasting power of attorney in the UK, and what about delays?

To register a lasting power of attorney in England and Wales, you send the completed forms to the Office of the Public Guardian (OPG). As of September 2026, the OPG estimates around 8 to 10 weeks to register an application with no errors. Mistakes cause further delays, so check names, the signing order and payment before sending, and see GOV.UK for the latest processing times.

  • What counts as proof of life for the UK?

Periodic proof of life checks can vary between paper forms, in-person verification, or secure digital systems.

  • How does an expression of wish interact with a will for pension funds?

Many pension death benefits are paid outside your estate, so your will may not decide who receives them. For most schemes, an expression of wish (or nomination) guides the provider or trustees, who usually keep discretion over who is paid; only some schemes treat a nomination as binding. Rules vary between schemes, so check with your provider and keep your nomination up to date alongside your will.

  • Can the nominee assistance service help when a beneficiary is overseas or incapacitated?

Absolutely. Our nominee assistance service helps your nominee oversee all essential transfers and transitions smoothly, such as collecting documents, managing bank formalities, and coordinating with probate offices or institutions. We also assist with overseas beneficiaries or situations where someone is unable to act for themselves.
